Terms & Conditions
1. In these terms of sale, “Modern Glaze Ltd” refers to the entity named in the header, and “Customer” refers to the individual, firm, or company from whom Modern Glaze Ltd accepts an order. “Goods” refers to the products or services that are the subject of the order, whether placed verbally or in writing.
2. The Customer agrees to purchase and have the Goods specified in the order installed.
3. Orders are custom-manufactured. Any Goods not used in their intended location within the Customer’s premises cannot be credited against the contract price.
4. The total outstanding balance is payable immediately upon proper installation or delivery of the Goods, in accordance with the terms of the contract. Payment must be made to the installer in cash or by cheque payable to Modern Glaze Ltd. Any outstanding balance not paid in full by the Customer on the installation date will accrue a monthly interest charge of 2.5%.
5. Modern Glaze Ltd will accept the order subject to a final technical survey, which will be carried out during daylight hours.
6. Modern Glaze Ltd reserves the right to cancel the order if the surveyor determines that Modern Glaze Ltd cannot fulfill its obligations to the Customer within the contract price. In this case, any deposit or payments made towards the contract will be refunded in full.
7. The Customer acknowledges that the items and diagrams in this contract have been reviewed and are correct.
8. Risk passes to the Customer when the Goods leave Modern Glaze Ltd’s premises, if collected by the Customer. Risk also passes when Modern Glaze Ltd has installed the agreed Goods.
9. Notwithstanding the transfer of risk, ownership of the Goods remains with Modern Glaze Ltd until payment has been made in full and cleared through Modern Glaze Ltd’s bank account.
10. The contract is not considered complete for the purpose of ordering a Building Control Certificate until the Customer has paid in full and signed the customer acceptance of installation sheet, confirming satisfaction with the installation and the completion of any snagging issues.
11. The Customer agrees to allow Modern Glaze Ltd, its employees, and workers access to the installation site at reasonable times for the completion of the scheduled work. If, within 28 days of being advised that Modern Glaze Ltd is ready to install, the Customer has not agreed on an installation date, the remaining balance of the bespoke product supply cost becomes payable. A bespoke product is one designed and manufactured to the Customer’s specifications (e.g., glass, frame color, or hardware).
12. The Customer will provide reasonable access to water and electricity at no charge.
13. Modern Glaze Ltd will take reasonable care to protect the Customer’s property during the work, but cannot accept responsibility for redecorating.
14. The contract price does not include repair or replacement of any rotten timber, defective lintels, hidden services, or hazardous materials (such as asbestos) discovered during the course of the work, unless specified in the work schedule. Any such necessary work will be communicated to the Customer and quoted separately.
15. Modern Glaze Ltd does not undertake to move ancillary services, fixtures, or fittings (e.g., radiators, pipes, electrical, telephone, or television cables). The Customer is responsible for removing all household fixtures (including curtains, nets, and blinds) before installation. Modern Glaze Ltd is not liable for any damage to items not removed by the Customer and reserves the right to charge for any wasted time due to site-specific restrictions.
16. Modern Glaze Ltd cannot guarantee that existing doors, windows, or frames will be suitable for reuse. These items will be removed and disposed of unless the Customer requests they be left. Efforts will be made to protect and clean the working areas, but Modern Glaze Ltd is not responsible for small fragments or splinters left behind.
17. Modern Glaze Ltd reserves the right to make minor changes to the specification of any product without prior notice to the Customer, in accordance with its policy of continuous development and improvement. Any changes will result in products of equal or improved quality.
18. Any product guarantee takes effect immediately upon completion of the work, provided the full price has been received by Modern Glaze Ltd by the due date (less any appropriate deductions for defects).
19. The Customer acknowledges that no alteration or cancellation of the order is permitted if the order is signed “subject to building society/bank/finance company approval,” unless written confirmation of finance refusal is provided. In such cases, the contract will be void, and any deposit paid will be refunded.
20. The delivery or installation period quoted is an estimate and may be shortened if possible. If the contract is not completed within the specified period, the Customer may serve written notice to Modern Glaze Ltd, requiring completion within six weeks. If the work is not finished by this extended date, the Customer may cancel the uncompleted portion of the contract without penalty and without forfeiting any deposit, by serving written notice to Modern Glaze Ltd. Modern Glaze Ltd is not liable for delays caused by circumstances beyond its control, and time will not be counted against the contract during such delays.
21. Modern Glaze Ltd’s liability to the Customer for any breach, non-performance, or other issues arising out of strikes, lock-outs, third-party non-supply, negligence, misrepresentation, or force majeure is limited to the price of the Goods specified in the order. Modern Glaze Ltd reserves the right to terminate the contract without compensation.
22. Modern Glaze Ltd does not claim or guarantee that its products will eliminate or reduce condensation.
23. Modern Glaze Ltd will, at its discretion, repair or replace Goods that become defective due to faulty materials or workmanship, in accordance with the written guarantee.
24. In the event of a dispute, the Customer agrees to use the dispute resolution services provided by Modern Glaze Ltd’s Certification Body or Competent Person Scheme Operator and be bound by their terms.
25. Nothing in these terms and conditions excludes or limits the Customer’s statutory rights.
26. This agreement will be governed by and construed in accordance with English Law.
